Client charged with Assault and Battery by Mob, 2nd degree (which carries up to 25 years), Assault and Battery by Mob, 3rd degree, Obstruction of Justice, and Unlawful Carrying of a Pistol. Negotiated with the prosecutor and client ultimately pled guilty to Unlawful Carrying of a Pistol and simple Assault and Battery, 3rd degree, both misdemeanors, in exchange for dismissal of the other charges. After conducting some research, the prosecutor agreed with Ms. Husted that the charge must be dismissed as this client had not broken any laws regarding renewal of her license plate and the stop (and arrest) was therefore invalid.
Client with a clean record charged with Domestic Violence, 3rd degree. Ms. Husted researched the elements of this charge and found that there was a lack of evidence to prove that her client and this individual were cohabitating at the time. Due to this, the prosecutor agreed to refer this client to the Pretrial Intervention Program (PTI) on the charge of Assault and Battery, 3rd degree instead - which meant this client did not have to complete the otherwise required Batterers Treatment. After completing PTI, this charge was dismissed and expunged from client's record.
Client charged with Domestic Violence, 2nd degree after an argument with her partner. Interviewed the alleged victim and obtained an affidavit confirming the incident was simply a misunderstanding. After presenting this to the prosecutor, the charge was dismissed.
